Abstract

Business actors in an effort to protect consumers during the covid 19 period, every restaurant business is required to have a Hygiene Worthy Certificate regulated in the Regulation of the Minister of Health of the Republic of Indonesia Number 1096 / Menkes / Per / VI / 2011 concerning Jasaboga Sanitation Hygiene and Surabaya Mayor Regulation Number 28 of 2020 concerning New Normal Order Guidelines for Corona Virus Disease 2019 (Covid-19) Pandemic Conditions in the City of Surabaya as an effort to protect consumers. Normative juridical research with statutory and conceptual approaches. Analysis of legal materials was carried out after this categorization. The legal materials used are primary legal materials in the form of statutory regulations, secondary legal materials in the form of journals, books, and legal materials from online media, as well as tertiary legal materials from dictionaries. After the legal material is collected, it will be grouped, compiled and described for further analysis to answer the problem formulation and achieve the research objectives. The implementation of the proper hygiene certificate is in accordance with the theory of legal effectiveness, because in it there are supporting rules, namely the Regulation of the Minister of Health of the Republic of Indonesia Number 1096 / Menkes / PER / VI / 2011 concerning Jasaboga Sanitation Hygiene supported by Circular number HK.02.01 / MENKES / 335/2020 Concerning the Protocol for the Prevention of Corona Virus Disease Transmission in the Workplace of the Service and Trade Sector (Public Area). Law enforcement is carried out by state civil servants and a task force is formed which is applied to each region. The last factor is culture, which is related to the existing human values of society to reduce or prevent transmission of Covid 19 so that it can be applied in the roadmap. Sanctions for business actors in the field of food services are administrative sanctions from the Head of the Regency / City Health Office in the form of a warning, written warning or revocation of the Proper Hygiene Certificate as well as giving compensation and / or regarding certain actions so that the losses suffered by consumers will not be repeated.
