Abstract
ABSTRACT Study International Humanitarian Law: Analysis of Israel-Palestine Conflict Violation Characteristics Analysis of the Characteristics of Conflict Violations Between Israelis and Palestinians in the Study of International Humanitarian Law, which took place from May 6 to May 21, 2021, began with clashes involving Palestinian protesters and the Israeli Police in May 2021, which coincided with the Lailatul Qadar and Jerusalem Day holidays. The clashes were the result of the planned expulsion of several Palestinians living in Sheikh Jarrah, East Jerusalem, by the Israeli Supreme Court. In these clashes, there has been a violation of international humanitarian law according to the 18th Den Haag Convention (1907) concerning methods and means of warfare, and according to Additional Protocol I to the 1949 Geneva Convention, Israel has committed a violation of the use of means of war and regarding methods of going to war, and violated the principles of humanity, the principle of distinction, and the principle of proportionality. To resolve the conflict in the Israeli-Palestinian armed conflict in the study of HHI, the International Court of Justice must be able to take firm action against any act that leads to crimes against humanity in accordance with the provisions of the 1998 Rome Statute. The research method used in writing this thesis uses a type of normative juridical research using the conceptual approach and statute approach, with juridical analysis linking the provisions of the 1949 Geneva Convention and the 15th Hague Convention (1907) to the events of the Israeli-Palestinian armed conflict in 2021. Based on the results of the research, in solving the Israeli-Palestinian conflict, the humanitarian principle is used as one of the basic principles in international humanitarian law intended to provide assistance without discrimination to people who are injured on the battlefield and to work with international and national capacities to reduce human suffering wherever this principle is found. Israeli aggression against Palestine violates the humanitarian principle; it also violates the principle of discrimination because Israel does not distinguish between civilians and combatants, because the victims are more civilians than combatants, and also the proportional principle. Each international agreement has regulated in detail the protection of civilians in armed conflict. Protection of civilians in armed conflicts is based on humanitarian principles.
