Abstract

ABSTRAK Penelitian yang berjudul Penerapan Sanksi Atas Pelanggaran Kode Etik Advokat Yang Menimbulkan Kerugian Klien bertujuan agar mengetahui dan memahami pertanggungjawaban etika terkait sanksi dan prosedur pengaduan terhadap Advokat yang telah melanggar kode etik profesi. Advokat adalah orang yang berprofesi memberi jasa hukum baik didalam maupun diluar pengadilan yang berlandaskan nilai-nilai Kode Etik Advokat dan memenuhi persyaratan berdasarkan ketentuan undang-undang. Kode etik adalah etika yang nilai-nilainya terkandung dalam nilai moral dan susila. Kode etik sangat penting guna menjaga agar advokat dalam berpraktek atau beracara tidak keluar dari nilai-nilai profesi sehingga advokat bisa menjaga citra dan martabat kehormatan profesinya, serta setia dan menjunjung tinggi kode etik dan sumpah profesi. Metode Penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian Normatif yang merupakan penelitian kepustakaan, yaitu penelitian terhadap peraturan perundang-undangan dan literature yang berkaitan dengan materi yang dibahas dan dalam penelitian ini menggunakan pendekatan Perundang-undangan (Statue Approach) yang dilakukan dengan mempelajari konsistensi atau kesesuian antara Undang-undang yang satu dengan Undangundang yang lain. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa yang pertama Advokat dalam menjalankan profesinya harus tunduk pada Undang-undang dan Kode Etik Profesi, karena aturan tersebut sebagai acuan bagi advokat untuk tidak berbuat hal-hal yang melenceng dari ketentuan peraturan perundang-undangan ' dan kode etik. Yang kedua advokat yang mendapatkan sanksi hukum dalam bentuk teguran lisan sampai pemberhentian secara tetap terkait adanya dugaan pelanggaran Kode Etik. Kata Kunci : Pelanggaran, Kode Etik Advokat, Penelantaran Klien ABSTRACT The research entitled Law Enforcement for Violations of Advocates' Code of Ethics Regarding Client Abandonment aims to know and understand ethical responsibility for Advocates who have violated the professional code of ethics. An advocate is a person whose profession is providing legal services both inside and outside the court based on the values of the Advocate Code of Ethics and fulfilling the requirements under sanctions and grievance prosedures the provisions of the law. The code of ethics is an ethic whose values are contained in moral and ethical values. The code of ethics is very important to ensure that advocates in practice or proceedings do not deviate from professional values so that advocates can maintain the image and dignity of their profession, and be loyal and uphold the code of ethics and professional oath. The research method used in this thesis uses a normative research method which is library research, namely research on laws and literature related to the material discussed and in this study uses a statutory approach (Statue Approach) which is carried out by studying the consistency or compatibility between one law and another. Based on the results of this study, it can be concluded that first, advocates in carrying out their profession must comply with the Law and the Professional Code of Ethics, because these rules serve as a reference for advocates not to do things that deviate from statutory provisions and the code of ethics. The second is an advocate who received legal sanctions in the form of a verbal warning until permanent dismissal regarding an alleged violation of the Code of Ethics.
