Abstract

Kepolisian Negara Republik Indonesia (Polri) is the party in charge of implementing law enforcement in the community. When the Police receive a complaint from the public who are victims of a criminal case, the Police are also obliged to accept the report as an institution that provides legal protection for every citizen. Several cases that have occurred show the unprofessionalism of the Police in handling criminal case complaints submitted by victims who were rejected because they were considered lacking evidence. In other words, the police's refusal to report complaints of criminal acts committed by the public due to lack of evidence constitutes the unprofessionalism of the police in handling reports of complaints of criminal acts. A complaint crime is an offense that harms a person's rights, which can only be processed legally if the injured person makes a report to the police. the existence of legal protection for victims of criminal acts. This is not only the main role of the police in society, but also as a manifestation of their position or status in the eyes of the law as an institution that is responsible for upholding the law in Indonesia. Therefore, the role of the police in protecting the rights of victims of criminal acts will depend on their active role in carrying out their duties as the main actors in maintaining public order in the eyes of the law. Making reports of criminal acts is not only the right of the victim, but also the obligation of the victim to make a report on the incident of the crime that happened to him. The police's refusal of criminal complaints filed by the public on the grounds of "lack of evidence" is the same as deviating from their duties and authorities as members of the POLRI. Therefore, when the community finds or feels for themselves the rejection of the criminal act they report, the community has several options when viewed structurally from the reporting process or public complaints related to the occurrence of a criminal act or something that legally can be considered as an act against the law, namely by coming to the court.
