Abstract

ABSTRACT This study, entitled Analysis of Sanctions for Postponement of Social Assistance for Refusal of Covid-19 Vaccination, the purpose of this paper is to determine the regulation of refusal of Covid-19 vaccination and to examine the imposition of sanctions for delaying or discontinuing social assistance contained in Presidential Regulation Number 14 of 2021 concerning changes Presidential regulation number 99 of 2020 concerning the procurement of vaccines and the implementation of vaccinations in the context of dealing with the COVID-19 pandemic. The method used in this thesis is using a normative research method with library research which is a study of the rules of legislation and literature or reading materials related to the material discussed. Based on the research conducted, there is a conclusion. First; Social assistance provided by the government in the form of cash assistance, basic necessities, MSME capital, to discounted electricity rates, in this assistance, which is given in cash or non-cash only as a social savior valve and a damper for social turmoil. Second, the Government in Direct Cash Assistance (BLT), which is a government assistance program in the form of providing cash or various other assistance such as basic necessities, both conditionally and unconditionally for the poor. Presidential Regulation Number 14 of 2021 concerning Amendments to Presidential Regulation Number 99 of 2020 concerning Vaccine Procurement and Vaccination Implementation in the Context of Combating the COVID-19 Pandemic needs to be reviewed (PK) to the Supreme Court to be revised because it has conflicted with many of the rules above it. Number 40 of 2004 concerning the National Social Security System and doubts about the validation and legitimacy of the making of these laws and regulations KEYWORDS: Social Assistance, Acceptance of Social Assistance, Administrative Sanctions ABSTRAK Penelitian ini yang berjudul Analisa Sanksi Penundaan Bantuan Sosial Bagi Penolakan Vaksinasi Covid – 19 yang bertujuan dari penulisan ini adalah untuk mengetahui pengaturan penolakan vaksinasi Covid -19 serta mengkaji pengenaan sanksi penundaan atau pemberhentian bantuan sosial yang ada di dalam Peraturan Presiden Nomor 14 Tahun 2021 tentang perubahan peraturan presiden nomor 99 tahun 2020 tentang pengadaan vaksin dan pelaksanaan vaksinasi dalam rangka penanggulangan pandemic covid-19. Metode yang digunakan dalam skripsi ini yakni menggunakan metode penelitian normatif dengan penelitian kepustakaan yang merupakan penelitian terhadap aturan Perundang-undangan dan literatur atau bahan bacaan yang berkaitan dengan materi yang dibahas. Berdasarkan penelitian yang dilakukan hasil penelitian terdapat suatu kesimpulan. Pertama; Bantuan sosial yang diberikan oleh pemerintah dalam berbentuk bantuan tunai, sembako, permodalan UMKM, hingga diskon tarif listrik, dalam bantuan ini yang diberikan tunai maupun non tunai hanya sebagai katup penyelamat sosial dan peredam gejolak sosial. Kedua, Pemerintah dalam Bantuan Langsung Tunai (BLT) yaitu program bantuan pemerintah yang berupa pemberian uang tunai atau beragam bantuan lainnya seperti sembako, baik bersyarat maupun tak bersyarat untuk masyarakat miskin. Peraturan Presiden Nomor 14 Tahun 2021 Tentang Perubahan Peraturan Presiden Nomor 99 Tahun 2020 Tentang Pengadaan Vaksin Dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi COVID-19 perlu dilakukan Peninjauan Kembali (PK) ke Mahkamah Agung untuk dapat direvisi karena sudah berbenturan dengan banyak aturannya diatasnya Undang – Undang Nomor 40 Tahun 2004 Tentang Sistem Jaminan Sosial Nasional dan diragukannya validasi serta keabsahaan pembuatan dari peraturan perundang – undangan tersebut KATA KUNCI: Bantuan Sosial, Penerimaan Bantuan Sosial, Sanksi Administrasi
