Abstract

Arrangements halal labeling of food products befbre the existence of the Halal Product Security Act has been regulated in the Food Act. However, the contents of different norm, which is mandatory for the Halal Product Security Act, whereas voluntary for the Food Act. While halal labeling regulated in the Consumer Protection Act is labeled of halal seller, then the goods sold must be in accordance with the specified label. Thus, there is a conflict of norms, that is between the Halal Product Security Act and the Food Act and its regulations on food labeling and advertising, and the Halal Product Securitv Act and the Consumer Protection Act. To resolve the conflict norm, then the validity of the juridical basis the Halal Product Security Act is Stufentheorie concept, which is based on the basic norm (Grundnorm) as the highest norm, which as stated in the Preamble to the Constitution of the Republic of Indonesia 1945 and the principle of preference, that is: the principle of Lex posteriori derogat legi priori and the principle of Lex superiori derogat legi inferiori.
